By downloading or using Gig Log App (previously known as KM Tracking App), provided by Cypher Novus PLT, you agree to the following Terms of Use.

1) License Grant
Cypher Novus PLT grants you a revocable, non-exclusive, non-transferable, limited license to download and use the application for personal or business record-keeping purposes, subject to these terms.

2) Record Keeping & Tax Compliance
You are advised to retain all original receipts and supporting documents in accordance with your local jurisdiction’s tax laws. For example : At least seven (7) years under the Income Tax Act 1967 in Malaysia. At least five (5) years under ATO guidelines in Australia. At least three (3) to seven (7) years under IRS guidelines in the United States.All records, calculations, and reports generated by this app are provided for reference and record-keeping purposes only.

3) User Responsibility
You are solely responsible for : Ensuring all entered data is accurate, complete, and truthful. Reviewing and verifying all reports before use or submission. Ensuring compliance with applicable tax laws, regulations, and reporting requirements in your country. Cypher Novus PLT does not provide tax, legal, or accounting advice.

4) Data Storage & Backup

Free version:
Data is stored locally on your device only and cannot be exported. Data may be permanently lost if the app is removed, or the device is lost or reset. 

Pro version:
Users may manually export backup files to a location of their choice (e.g., Cloud Storage, External Drive, etc.). The safekeeping of this backup file is the sole responsibility of the user. If a backup is not saved externally, data may still be permanently lost due to device loss, reset, or app removal.

5) Subscriptions, Auto-Renewals & Refunds

All subscription purchases are handled by the respective app stores (Google Play or Apple App Store). Subscriptions automatically renew unless canceled at least 24 hours before the end of the current billing period.

Refunds: We do not process payments directly and therefore cannot issue refunds, prorated or otherwise, for canceled subscriptions. Any requests for refunds must be directed to the customer support of the platform where the purchase was made (Google Play or Apple) and are subject to their respective refund policies and applicable local consumer protection laws.

6) Disclaimer of Warranties
SUBJECT TO APPLICABLE CONSUMER LAWS (INCLUDING THE AUSTRALIAN CONSUMER LAW AND US STATE CONSUMER PROTECTION LAWS), THE APPLICATION IS PROVIDED “AS IS” AND “AS AVAILABLE”, WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. WE DO NOT GUARANTEE UNINTERRUPTED OR ERROR-FREE OPERATION, COMPLETE ACCURACY OF CALCULATIONS, OR PERFECT DATA PRESERVATION UNDER ALL CIRCUMSTANCES.

7) Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, CYPHER NOVUS PLT SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, OR CONSEQUENTIAL DAMAGES, INCLUDING BUT NOT LIMITED TO:Tax penalties, audit outcomes, or assessment adjustments.Loss of data. Loss of profits or business opportunities.

Note for US and specific jurisdictions: Some states or jurisdictions do not allow the exclusion or limitation of incidental or consequential damages, so the above limitations or exclusions may not apply to you.

8) Governing Law & Dispute Resolution
These Terms shall be governed by and interpreted in accordance with the laws of Malaysia, without regard to its conflict of law provisions. If any provision of these Terms is held to be invalid or unenforceable by a court of competent jurisdiction, the remaining provisions will remain in full force and effect.

9) Language & Governing Version
In case of any inconsistency between translations of this document, the English version shall prevail.
